1. Agreement to these Terms

These Terms and Conditions ("Terms") are a legal agreement between you and Still Safe LLC ("Still Safe," "we," "us," or "our") governing iHomePlan and related cloud, website, support, and app services (collectively, the "Service").

By downloading, accessing, creating an account for, purchasing through, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind it.

2. What iHomePlan provides

iHomePlan helps homeowners organize inspection reports and home projects. Features may include report upload and AI-assisted analysis, findings and source references, planning cost ranges, DIY or professional guidance, projects and roadmaps, documents and photos, quotes, schedules, reminders, professional search, exports, and home sharing.

Features may change as the Service develops. Some features require an internet connection, Sign in with Apple, device permission, a one-time purchase, or an active subscription. We may set reasonable storage, processing, sharing, and usage limits to protect the Service.

3. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into a binding agreement to use iHomePlan. The Service is not intended for children.

You are responsible for your account, your Apple account and device security, and activity performed through your account. Keep your information accurate and notify us promptly if you suspect unauthorized access. You may not sell, rent, transfer, or share account credentials.

4. Your content and responsibilities

"Your Content" includes reports, addresses, photos, documents, notes, quotes, contracts, receipts, warranties, permits, professional information, and other material you upload, enter, generate, or share through the Service. You retain ownership of Your Content.

You grant Still Safe a limited, worldwide, non-exclusive license to host, copy, process, transmit, format, and display Your Content only as reasonably necessary to operate, secure, improve, and support the Service and provide features you request. This license ends when the content is deleted, except for limited backup, legal, security, and shared-content retention described in the Privacy Policy.

You represent and agree that:

• you own Your Content or have permission to upload and use it;
• Your Content and your use of it do not violate law, privacy, confidentiality, contract, or intellectual-property rights;
• you will review important information before relying on or sharing it; and
• you are responsible for maintaining independent copies of records you cannot afford to lose.

5. Home sharing and invitations

If you share a home, authorized members may view or edit home information according to their role. You are responsible for choosing recipients, protecting invitation links, reviewing membership, and removing access when appropriate. Do not share access with anyone who should not see private home, financial, or document information.

Removing a member stops future server access, but previously cached content may remain on an offline device until it reconnects and receives the access change. A home owner controls ownership-sensitive actions. Ownership transfers require acceptance by the new owner.

If an account owner deletes a shared home or deletes their account without first completing an ownership transfer, other members may permanently lose access and the shared content may be deleted.

6. AI-assisted features and professional disclaimer

iHomePlan uses artificial intelligence to help extract, summarize, organize, and compare information. AI output is probabilistic and may be inaccurate, incomplete, outdated, duplicated, misleading, or unrelated to the source. A source-page reference does not guarantee that the interpretation is correct.

Cost ranges are planning estimates, not bids or guarantees. Priorities and DIY or professional guidance are informational. Conditions can change, and reports may omit concealed or later-developing issues. Before making safety-sensitive, structural, electrical, plumbing, environmental, financial, insurance, or expensive decisions, consult appropriately qualified and licensed professionals and obtain independent quotes.

Do not delay urgent action because of the Service. If you suspect an immediate danger, stop work, leave the area when appropriate, and contact emergency services or a qualified local professional.

7. Professionals, listings, maps, and external services

Professional listings, ratings, reviews, contact details, maps, directions, and business information may come from Google, Apple, users, or other third parties. They may be inaccurate, incomplete, or stale. Inclusion is not an endorsement, verification, recommendation, warranty, or statement about licensing, insurance, reputation, availability, or quality.

Still Safe is not a contractor, broker, marketplace, employer, insurer, or party to any agreement between you and a professional. You are responsible for checking licenses, insurance, references, permits, scope, pricing, contracts, warranties, and applicable law. Any dealings with third parties are between you and them.

External services and links are governed by their own terms and privacy policies. Availability may vary by language, device, location, provider, or network.

8. One-time purchases and subscriptions

App Store billing

Purchases are processed by Apple through your App Store account. Prices, taxes, billing periods, trial terms, and included features are shown before purchase. We do not receive your full payment-card information.

One-time inspection analysis

A one-time analysis purchase grants one non-transferable analysis credit associated with your account. The credit is generally consumed when an eligible report analysis successfully completes. It has no cash value and may not be resold. Duplicate, refunded, revoked, fraudulent, or previously redeemed transactions do not grant additional credits. Any eligible rerun or recovery conditions are described in the app and may be limited to the same report content.

Subscriptions

If you purchase HomePlan Pro, payment is charged to your App Store account at confirmation. The subscription automatically renews unless you cancel at least 24 hours before the current period ends. Your account may be charged for renewal within 24 hours before that period ends. You can manage or cancel in your Apple account subscription settings. If a trial is offered, any unused portion may be forfeited when you purchase a subscription where permitted by Apple.

Canceling stops future renewal but ordinarily does not refund the current period. Refund requests are handled by Apple under its policies and applicable law. Deleting iHomePlan or your iHomePlan account does not cancel an App Store subscription. We may change future prices or plan features with notice required by Apple or law.

9. Acceptable use

You may not, and may not help others to:

• use the Service unlawfully, fraudulently, deceptively, or to harm another person;
• upload malware, unlawful content, or content you do not have the right to use;
• gain unauthorized access to another account, home, invitation, system, or data;
• probe, disrupt, overload, scrape, automate against, or interfere with the Service or its security;
• bypass purchase, entitlement, storage, rate, access, or usage controls;
• reverse engineer or attempt to derive source code except where applicable law expressly permits it;
• misrepresent AI output as a certified professional opinion or guaranteed fact; or
• use the Service to develop or train a competing model or service without our written permission.

We may investigate suspected misuse and apply reasonable technical limits.

10. License, intellectual property, and feedback

The iHomePlan app is licensed, not sold. Subject to these Terms and Apple's Usage Rules, Still Safe grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the app on Apple-branded devices you own or control, including permitted Family Sharing or volume-purchase use.

The Service, software, design, branding, and content provided by Still Safe are owned by Still Safe or its licensors and protected by intellectual property laws. No rights are granted except those expressly stated.

If you provide ideas or feedback, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation, without identifying you.

11. Suspension, termination, and account deletion

You may stop using the Service at any time and may request account deletion in the app. Deletion is subject to the 72-hour cancellation period and shared-home consequences described in the Privacy Policy.

We may suspend, limit, or terminate access if you materially violate these Terms, create risk or legal exposure, fail to pay applicable charges, or if needed to protect users, third parties, or the Service. Where reasonable, we will provide notice and an opportunity to resolve the issue.

Provisions that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitations of liability, indemnification, and dispute terms.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available," with all faults and without warranties of any kind. Still Safe disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and that the Service will be uninterrupted or error-free.

We do not warrant that any report will upload or parse successfully, that AI output will identify every issue, that reminders will arrive, that stored records will satisfy legal or insurance requirements, or that third-party information will be current or accurate. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

13. Limitation of liability and indemnification

To the maximum extent permitted by law, Still Safe and its officers, members, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, loss of data, property damage, personal injury, substitute services, or decisions made in reliance on the Service, even if advised that such damages are possible.

To the maximum extent permitted by law, our total liability arising from or related to the Service will not exceed the greater of (a) the amount you paid for the Service during the 12 months before the event giving rise to the claim or (b) US $100. These limitations do not apply where prohibited by law, including liability that cannot legally be limited.

To the extent permitted by law, you agree to defend, indemnify, and hold Still Safe harmless from third-party claims arising from Your Content, your unlawful or unauthorized use of the Service, or your material violation of these Terms. This obligation does not apply to the extent a claim results from Still Safe's own unlawful conduct.

14. Additional Apple App Store terms

If you obtained iHomePlan through Apple's App Store, you and Still Safe acknowledge and agree that:

• these Terms are between you and Still Safe, not Apple, and Still Safe is solely responsible for iHomePlan and its content;
• your app license is limited to the scope permitted by Apple's Usage Rules and the license in Section 10;
• Still Safe, not Apple, is responsible for maintenance and support, and Apple has no obligation to provide either;
• to the extent any applicable warranty cannot be disclaimed, you may notify Apple and Apple may refund the app's purchase price, if any; Apple has no other warranty obligation to the maximum extent permitted by law;
• Still Safe, not Apple, is responsible for claims relating to iHomePlan, including product-liability, regulatory, consumer-protection, and privacy claims;
• Still Safe, not Apple, is responsible for investigating, defending, settling, and discharging any claim that iHomePlan infringes third-party intellectual-property rights;
• you must comply with applicable third-party terms when using iHomePlan;
• you represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a U.S. Government prohibited or restricted-party list; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

Apple's Standard Licensed Application End User License Agreement also applies except where these Terms validly provide different terms.

15. General terms

Changes

We may update these Terms to reflect changes to the Service, law, or our business. We will post the updated Terms and revise the effective date. We will provide additional notice when required. Your continued use after the effective date means you accept the updated Terms.

Governing law and venue

These Terms are governed by the laws of the State of Kansas and applicable United States federal law, without regard to conflict-of-law principles. Subject to any mandatory rights under the laws where you live, disputes will be brought in the state or federal courts located in Kansas, and you consent to their jurisdiction.

Consumer rights

Nothing in these Terms limits non-waivable consumer rights or remedies under applicable law.

Assignment, severability, and waiver

You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, merger, acquisition, or sale of assets. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver.

Entire agreement

These Terms, the Privacy Policy, purchase terms shown in the app, and applicable Apple terms form the entire agreement concerning the Service and replace prior discussions or agreements on the same subject.
